Disclaimer cum Indemnity cum Affidavit

I, the Participant / Declarant / Indemnifier named above, do hereby solemnly affirm, certify and declare as under:

1. 1. I have read and understood all rules and regulations, including the safety rules, and have been briefed on the safety precautions for the adventure activities (Zipline, Sky Cycle, Climbing Wall, Quick Jump, Zip Surfing, Paintball and Go-Karting) conducted at Xtreme Arena, Takhatpur Main Road, Near Khamhariya Village, Bilaspur, Chhattisgarh (hereinafter "the Indemnified").
2. 2. I am participating voluntarily and of my own free will. I understand that adventure activities are inherently risky and may result in injury, serious injury, permanent disability or death. I knowingly and voluntarily accept all such risks.
3. 3. I declare that I am in sound health and mentally and physically fit to participate. I am not pregnant and do not suffer from any heart condition, hypertension, asthma or other respiratory disorder, epilepsy, haemophilia, vertigo, back/neck/joint injury, recent surgery, or any other condition that could be aggravated by, or interfere with, safe participation. I have disclosed any relevant medical condition to the staff in writing.
4. 4. I have not consumed alcohol, narcotics or any psychotropic substance before the activity and understand that participation under their influence is strictly prohibited.
5. 5. I shall follow all rules, briefings and instructions of the instructors, marshals and staff at all times, wear all safety equipment as instructed, and shall not tamper with any equipment, harness, kart or track. I shall immediately report any hazard or unsafe condition I notice.
6. 6. The Indemnified and its staff have the sole discretion to stop the activity or remove me from the activity area at any time, including before completion, if in their opinion I have compromised or may compromise the safety of myself, others or the equipment. I shall not dispute such decision and shall not be entitled to any refund.
7. 7. Go-Karting: I hold a valid driving licence (or, if a minor, my parent/guardian confirms my competence and takes full responsibility). I shall drive within the track rules and speed limits, and shall be liable for the cost of repair of any damage caused to the kart, barriers or track through my rash or negligent driving.
8. 8. Paintball: I shall keep my protective mask on at all times within the game zone, shall not remove it until instructed, shall not fire at any person outside the game zone or at a range closer than permitted, and shall not fire at the head of any player. I accept that welts and bruising are a normal part of the game.
9. 9. Height-based activities (Zipline, Sky Cycle, Climbing Wall, Quick Jump, Zip Surfing): I confirm I meet the age, height and weight limits displayed at the site, and I understand that the operator may refuse participation where these limits are not met.
10. 10. I am solely responsible for my personal belongings. The Indemnified shall not be liable for any loss, theft or damage to them.
11. 11. I consent to the Indemnified arranging first aid and/or transport to a hospital in an emergency, at my cost, and I authorise medical treatment if I am unable to consent at the time.
12. 12. I consent to photographs and videos of my participation being taken and used by the Indemnified for promotional purposes without compensation.
13. 13. I agree to indemnify and hold harmless Xtreme Arena, its owners, partners, directors, employees, instructors, contractors, sponsors and agents from and against all claims, demands, actions, costs, expenses, losses, liabilities and damages of whatsoever nature — including death, personal injury and damage to property of myself or any third party — arising out of or in connection with my participation in the activities, to the fullest extent permitted by law.
14. 14. I acknowledge that this Disclaimer cum Indemnity cum Affidavit is binding on me, my heirs, legal representatives, executors and assigns. Any dispute shall be subject to the exclusive jurisdiction of the courts at Bilaspur, Chhattisgarh.

I confirm that the above particulars are true and correct, that I am a major and competent to execute this document, and that I have signed it voluntarily with full understanding of its contents. Where the participant is below 18, I sign as parent or legal guardian, accept all risks on the minor's behalf and undertake all obligations and indemnities herein as if I were the participant.
